Welcome to the Gang of Kids store. The Terms & Conditions you are reading serve as a set of rules defining the purchasing process, payments, delivery, and returns. We created this document to ensure your shopping experience is safe, transparent, and fully compliant with applicable consumer protection laws. § 1. General Provisions and Contact Details
- The online store available at www.gangofkids.com is operated by Aftervision Dagmara Owczarek, NIP: 6681941007, REGON: 366308875, with its registered physical address at: ul. Spacerowa 10, 62-731 Przykona, Poland (hereinafter referred to as the "Seller").
- Contact with the Seller (DSA Single Point of Contact): You can contact us regarding any order, complaint, or general inquiry via email at: hello@gangofkids.com. This email also serves as the single point of contact for electronic communication in accordance with the Digital Services Act (DSA).
§ 2. Key Definitions
- Customer (Buyer): A natural person, legal entity, or organizational unit making purchases in the Store.
- Consumer: A natural person making purchases not directly related to their business or professional activity.
- Store: The e-commerce platform located at www.gangofkids.com.
- Product: A movable item available in the Store. Gang of Kids products are predominantly crafted by hand (handmade).
- Customer Account: A free electronic service consisting of a secure, individual panel provided to the Customer.
§ 3. Handmade Product Characteristics and Safety (GPSR)
- Most products offered in the Store are handmade. Due to the artisanal nature of production, slight variations in the weave, yarn shades, or dimensions are permissible. These variations are proof of the product's uniqueness and do not constitute a defect.
- The Seller guarantees that all offered products comply with the EU General Product Safety Regulation (GPSR).
- Safety Rules: Products intended for infants and children must always be used under adult supervision. The Customer is obliged to regularly check the product's condition before use and discontinue use if any damage is noticed.
§ 4. Order Process, Prices, and Promotions (Omnibus)
- The Store accepts orders 24/7.
- Prices: All prices listed in the Store are gross prices. They do not include shipping costs or international customs duties.
- Promotions (Omnibus Directive): In the event of a price reduction, the Store will display the lowest price of the Product that was in effect during the 30 days prior to the application of the price reduction.
- B2B VAT Invoices (KSeF): A business customer wishing to receive a VAT invoice must provide full company details and their VAT ID in the "Order Notes" field. Invoices are issued electronically (and registered in the Polish National e-Invoice System - KSeF for Polish entities).
§ 5. Payment Methods
- The Customer must pay for the order immediately upon placing it. Unpaid orders will be canceled within 24 hours.
- The Store uses external, encrypted payment gateways. Available methods include:
- Shopify Payments (Stripe): Credit and debit cards (Visa, Mastercard, Amex) and mobile payments (Apple Pay, Google Pay, Shop Pay, BLIK).
- PayPal.
- Klarna: Deferred payment option ("Pay in 30 days"), available in selected regions.
§ 6. Lead Time, Delivery, and Customs
The preparation time for shipping depends on product availability.
- For in-stock products, the lead time is up to 3 business days.
- For "Made to order" products, the lead time is up to 14 business days.
Delivery Options:
- For deliveries within Poland, we use InPost Courier (direct delivery to address).
- For European Union countries, deliveries are carried out by DPD.
- For international and non-EU shipping, we use FedEx and Global Express.
Important for Non-EU Customers: Orders shipped outside the EU may be subject to local customs duties, import taxes, or VAT. These extra costs are not included in the product or shipping price. The Buyer is entirely responsible for paying these fees to their local authorities.
§ 7. Right of Withdrawal (Returns) and Exceptions
- The Consumer has the right to withdraw from the contract without giving any reason within 14 days from the day of receiving the product.
- To initiate a return, the Consumer must inform the Seller via email (hello@gangofkids.com). The Consumer may, but is not obligated to, use the return form available for download in the "Delivery & Returns" tab on our website.
- The returned product must show no signs of use, have original tags, and be undamaged.
- Costs and Refunds: The Consumer bears the direct cost of returning the goods. The Seller shall refund all payments received from the Consumer within 14 days of being informed of the withdrawal. The Seller may withhold the refund until the returned Product is received or until the Consumer provides proof of returning it.
- Exceptions to Returns: The right of withdrawal does not apply to products created upon the Customer's specific request, clearly personalized, or manufactured to the Customer's individual specifications.
§ 8. Complaints Procedure (Liability for Conformity)
- The Seller is liable to the Consumer for any lack of conformity of the Product with the Sales Agreement existing at the time of delivery and becoming apparent within two years from that time.
- If a defect is found, the Customer has the right to file a complaint via email at hello@gangofkids.com, attaching photos and a description of the issue.
- Complaints are processed within 14 days from the date of submission.
- Natural wear and tear (such as the natural pilling of wool) is a standard characteristic of the material and does not constitute a defect.
§ 9. User Content and Reviews (Digital Services Act & Omnibus)
- Reviews: The Store ensures that published reviews come only from verified Customers who have purchased the product, in compliance with the Omnibus Directive.
- Content Moderation (DSA): It is strictly prohibited for Users to upload or publish any illegal content, spam, or content violating the rights of third parties in product reviews or forms. The Seller reserves the right to remove such content in accordance with the Digital Services Act.
§ 10. Out-of-Court Dispute Resolution (ODR) and Final Provisions
- Consumers have the right to use out-of-court complaint and redress mechanisms. The European Commission provides a platform for online dispute resolution (ODR) between Consumers and Entrepreneurs, available at: http://ec.europa.eu/consumers/odr.
- In matters not covered by these Regulations, the applicable laws of the Republic of Poland and European Union consumer protection laws shall apply.
